Best Practices for Complying with New E-Liquid Packaging Regulations

Since its introduction in mid-2000s, the burgeoning e-liquid industry has transformed from subculture status to mainstream. Vaping products are fast becoming the new trend and e-cigs are considered better alternatives to traditional smoking methods. However, with a booming rise in popularity, new federal regulations have been implemented that affect the packaging standards.

Here’s a brief overview on state-approved e-liquid packaging regulations that you need to comply with.

The Federal Labeling Regulations

E-liquids must be subject to the following state-compliant labeling and packaging regulations:

Health Warning

The standard health warning, ‘This product contains nicotine which is a highly addictive substance’ must at least cover 30% of the two most visible areas of the product’s packaging.

Ingredients

The ingredients of the contents must be clearly stated and must be listed down in a descending order, according to weight. The nicotine content of the product should be clearly evident.

Nicotine Dosage

The amount of nicotine intake per dose that the e-liquid content will provide to its consumer should be clearly indicated on the packaging.

Directions

How the product is meant to be consumed should be clearly stated in the direction for use part. Everything from how much the device should be filled to proper disposal of the container’s content.

Other Instructions

Other standard instructions such as the proper storage of the product and its shelf life, plus who it’s suitable for, and if there any known side effects of the product should be listed on the packaging.

Other E-Liquid Requirements

An e-liquid product must abide by these further state regulations aside from the one mentioned above:

  1. E-liquid products must not be supplied or sold in bottles greater than 10ml.
  2. The strength of the e-liquid cannot be greater than 20mg per ml.
  3. The contents of an e-liquid product must be highly pure and should not contain certain toxic chemicals.
  4. E-liquid packaging must be child resistant and tamper-proof. It should not easily break or leak its contents.
  5. It should have a declaration that the manufacturers or importers of the product take full responsibility of the safety and quality of the product.

Who Do These Regulations Apply to?

  • Retailers selling the product to end-users.
  • Wholesale suppliers selling the product to retailers or other wholesalers.
  • E-liquid producers and manufacturers.

Keeping up with the state guidelines regarding labeling and packaging is vital and necessary for staying out of legal trouble. Make sure your packaging solutions are state compliant.
